2. The petitioner seeks bail in connection with Biraul P.S. Case No. 268 of 2026, instituted for the offences punishable under Sections 191(2), 191(3), 190, 126(2), 127(2), 109(1), 118(1), 117(1), 115(2) and 303(2) of the Bharatiya Nyaya Sanhita, 2023.

3. The prosecution case, in short, is that the petitioner along with other co-accused persons assaulted the informant and other persons by means of iron rod, lathi and danda. It is further

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. Charge-sheet has been submitted in this case. No incriminating material has been recovered from the conscious possession of the petitioner. Learned counsel for the petitioner also submits that no such type of occurrence has been committed by the petitioner. The allegation levelled against the petitioner is not specific. It is next submitted that the injury sustained by the informant is found to be simple in nature. It is further submitted that there is case and counter case between the parties. The petitioner is in custody since 06.05.2026 and has got no criminal antecedent.

5. Learned APP for the State has vehemently opposed the prayer for grant of bail to the petitioner.

6. Considering the aforesaid facts and circumstances of the case, case and counter case between the parties and taking into account the period of custody undergone by the petitioner, this Court is inclined to grant bail to the petitioner.

7. Let the petitioner be released on bail on furnishing bail bonds of Rs. 15,000/- (Rupees Fifteen Thousand) with two
