The petitioner is seeking regular bail in Patepur P.S. Case No. 38 of 2018 registered under Section 366(A)/34 of Indian Penal Code.

Learned counsel for the petitioner submits that the brother of the petitioner as well as victim girl are major and they seem to have performed marriage with their own will and volition. Learned counsel for the petitioner submits that in fact the victim girl along with her husband Ranjan Kumar (brother of this petitioner) have moved the Hon'ble Delhi High Court in W.P. (Cri) No. 723/2018 seeking protection of their life as they apprehended threat from the family of the victim lady. Learned

Patna High Court Cr.Misc. No.33717 of 2018 (2) dt.14-06-2018 2/2 counsel has placed before this court Annexure-2, which is a copy of the order dated May 9th, 2018 passed by the Hon'ble Delhi High Court from which it has been shown to this court that both of them had an interactions with the Hon'ble Judge and in course of their interactions they informed the Hon'ble Judge about their being major and having performed marriage with their free consent. Learned A.P.P for the State is present.

Considering the fact that this petitioner is brother of Ranjan Kumar and that both Ranjan Kumar and the victim lady have moved the Hon'ble Delhi High Court in the given facts and circumstances, I am inclined to grant regular bail. Let the petitioner, above named, be released on bail on his furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, X, Vaishali at Hajipur in Patepur in connection with Vaishali at Hajipur in Patepur P.S. Case No. 38 of 2018, subject to the conditions as laid down under Section 437(3) Cr.P.C.
