JUSTICE DINESH KUMAR SINGH ORAL ORDER 13-04-2016 The petitioner being husband of the informant is apprehending his arrest in a case registered for the offences punishable under Sections 498A, 494, 379, 34 of the Indian Penal Code.

The basic accusation is of torture and performing second marriage.

It is submitted by learned counsel for the petitioner that petitioner admits his marriage with the informant but since informant deserted the petitioner, hence petitioner has performed second marriage.

It is submitted by learned counsel for the informant that since petitioner has driven out the informant from the matrimonial house after performing second marriage, hence informant is not ready to reside with the petitioner.
