1. Heard learned counsel for the petitioner, the learned counsel appearing on behalf of the informant and learned APP for the State.
2. The petitioner seeks bail in anticipation of his arrest in a case registered for the offences punishable under Sections 137(2), 351(2), 351(3) of the B.N.S. and Section 4 of the POCSO Act.
3. The learned counsel for the petitioner submits that the petitioner and the victim were in love and they eloped and they have performed their marriage. It is further submitted that this fact was also in the knowledge of the informant which would manifest from the fact that date of occurrence is
Patna High Court CR. MISC. No.49442 of 2025(3) dt.24-09-2025 2/2 16.08.2024 and the FIR was instituted on 05.09.2024.
4. The learned for the informant also submits that he has instruction not to oppose the anticipatory bail application.
5. Considering the submissions made by the learned counsel for the petitioner, the petitioner, above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on anticipatory bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Court POCSO-cum-VIIth District and Additional Sessions Judge, Bhagalpur in connection with Sultanganj P. S. Case No.417 of 2024, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
6. The application stands allowed.
