The petitioner is seeking regular bail in Digha P.S. Case No. 47 of 2018, G.R. No. 558 of 2018 registered under Sections 392, 34 of the Indian Penal Code.
It is submitted on behalf of the petitioner that the petitioner is aged about 19 years, he is in custody for about five months by now in connection with the present case wherein it is alleged that he was accompanying the co-accused Kumar Anubhav on the motorcycle and had participated in the occurrence of snatching the mobile phone in question. Learned counsel submits that the co-accused Kumar Anubhav, against whom there
Patna High Court Cr.Misc. No.33474 of 2018 (2) dt.14-06-2018 2/3 is an allegation of actively participating in commission of the alleged occurrence, has been granted privilege of regular bail by a learned coordinate bench of this court in Criminal Miscellaneous No. 26740 of 2018. Learned counsel submits that considering the age of the petitioner, this court may give him an opportunity to mend his ways and for that purpose his father is ready and willing to become one of the bailors.
Learned A.P.P for the State is present.
Considering the submissions on behalf of the petitioner whereunder the petitioner is said to be aged about 19 years only and the co-accused Kumar Anubhav has been granted regular bail by a learned co-ordinate bench of this court as also that the father of the petitioner is willing to become a bailor, this court is willing to enlarge the petitioner on bail giving him an opportunity to mend his ways. Let the petitioner, named above, be released on bail on his furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M, Patna in connection with Digha P.S. Case No. 47 of 2018, G.R. No. 558 of 2018. One of the bailors would be the father of the petitioner. In case the petitioner is found involved in any other occurrence of criminal nature, the prosecution would be free to move an application in the court below for cancellation of
Patna High Court Cr.Misc. No.33474 of 2018 (2) dt.14-06-2018 3/3 bail of the petitioner. These conditions whould be apart from those provided under Section 437(3) of Cr.P.C.
