JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 31-07-2019 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Mufassil P.S. Case No. 235 of 2019 for the offence under Sections 272, 273 of the Indian Penal Code and Sections 30(a), 41(i) and 32 of the Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioner submits that the petitioner is aged about 65 years. He further submits that the petitioner has got no criminal antecedent and he is in custody since 07.06.2019. He further submits that in the instant case total 315 litres of liquor was seized.

Considering the age of the petitioner and also the fact that the petitioner has got no criminal antecedent, the petitioner, named above, is directed to be released on bail on furnishing

No.47738 of 2019(2) dt.31-07-2019 2/2 bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-IX-cum- Special Judge, Excise Act, East Champaran, Motihari in connection with Mufassil P.S. Case No. 235 of 2019.
