The petitioner seeks regular bail in connection with Laheri P.S. Case No. 72 of 2018, registered for the offences punishable under Sections 363, 366(A)/34 of the Indian Penal Code.
The allegation against the accused persons including the petitioner herein is regarding abducting the victim girl. The learned counsel for the petitioner submits that the statement of the victim girl made under Section 164 Cr.P.C. is absolutely different from the F.I.R. It is further submitted that similarly situated co-accused person, namely, Ganesh Kumar has already been enlarged on bail.
Per contra, the learned counsel appearing on behalf of the informant has submitted that the victim girl has fully supported

No.34281 of 2018(3) dt.23-07-2018 2/2 the case of the prosecution in her statement made under Section 164 Cr.P.C. and the petitioner has been named as the main accused person. It is further submitted that the prayer for bail made by the co-accused person from whose house the victim girl was recovered has already been rejected by an order dated 04.07.2018 passed in Criminal Miscellaneous No. 38603 of 2018. Lastly, it is submitted that the case of the co-accused, who has been granted bail by a co-ordinate Bench of this Court by an order dated 02.07.2018 passed in Criminal Miscellaneous No.
37225 of 2018, is absolutely different from the present case inasmuch as neither he is the person from whose house the victim girl has been recovered and the only allegation against the said person is that the sim card given by the co-accused Ravi Kumar to the victim girl was standing in his name, hence, on this ground alone, the said co-accused has been granted bail. I have heard the learned counsel for the parties and perused the materials on record as also the case diary and I find that there are ample materials to prima facie constitute the offences as alleged against the petitioner herein, hence, his prayer for bail is rejected.
