This application for anticipatory bail arises out of Sitamarhi P.S. Case No. 578 of 2021 for the offence punishable under Sections 341, 323, 504, 354-A, 354-B, 354-D/34 of the Indian Penal Code and under Section 8 and 12 of the POCSO Act.
The petitioner no.1 is the mother of petitioner no.2. Though there is allegation against her but considering the fact that she is a lady and there is no chance of her absconding, this

Let the petitioner no.1, above named, in the event of his arrest/surrender within four weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District & Sessions Judge, 6th, Sitamarhi, in connection with Sitamarhi P.S. Case No. 578 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. So far as the bail of petitioner no. 2 is concerned, the same is dismissed as there is direct allegation against him of outraging the modesty of a 14 years of girl with his brother.
