The petitioner is in custody in connection with Gopalpur P.S. Case No. 265 of 2017, corresponding to Special Case no. 142/2018 registered under sections 30(A) of the Bihar Prohibition and Excise Act, 2016.

Learned Counsel for the petitioner submits that in the past petitioner has been made accused in Gopalpur P.S. Case no. 266 of 2017 for the offence punishable under section 307, 506 of the Indian Penal Code and not for offence pertaining to Bihar Prohibition Excise Act. He further submits that the liquor was seized from the house of co-accused Dipu Singh and not from this petitioner.

Considering the above let the petitioner, named above,

Patna High Court Cr.Misc. No.33948 of 2018(2) dt.06-06-2018 2/2 be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna, in connection with Gopalpur P.S. Case No. 265 of 2017 corresponding to Special case no. 142/2018.
