====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 25-06-2018 Heard Sri Ravi Shankar Sahay, learned counsel, assisted by Sri Arvind Kumar, learned counsel for the petitioner and Sri Kumar Virendra Narayan, learned Addl. Public Prosecutor.
The sole petitioner, who is in custody since 25.04.2018 in Bagaha P.S. Case No. 179 of 2017 registered for the offence under Sections 147, 148, 149, 323, 324, 325, 307, 379, 504 of the Indian Penal Code, has prayed for grant of bail. Learned counsel for the petitioner, at the very outset, has drawn my attention to Annexure-2 to the petition to show that from the petitioner side, one case was registered. Meaning thereby that there was case and counter case in between the parties on trivial issue. It has also been argued that of course in
Patna High Court Cr.Misc. No.33988 of 2018(2) dt.25-06-2018 2/2 the F.I.R. Section 307 of the Indian Penal Code has been added, but on examination of the Injury Report it would appear that Section 307 of the Indian Penal Code is not applicable in the present case. Learned counsel for the petitioner has also drawn my attention to the statement made in paragraph-3 of the petition to show that the petitioner is having clean antecedent. Considering the nature of accusation, clean antecedent of the petitioner as well as the fact that there was case and counter case in between the parties, let the petitioner, namely, Pappu Yadav be enlarged on bail on furnishing bail bond of Rs.10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.1st , Bagaha, West Champaran in connection with Bagaha P.S. Case No.179 of 2017.
