The petitioner seeks pre-arrest bail in connection with Sarai P.S. Case No. 136 of 2015 registered under Section 414 of the Indian Penal Code.

It is contended by the learned counsel for the petitioner that the petitioner is neither named in the FIR nor any incriminating article has been recovered from his possession and he has been implicated in the case merely on the basis of confessional statement of co-accused Munna Kumar. Be that as it may, regard being had to the nature of

No.13951 of 2016 (2) dt.01-04-2016 2 / 2 the offence as also the fact that the name of the petitioner transpired in course of investigation and the investigation is still going on , I am not inclined to grant anticipatory bail to the petitioner. Accordingly, the application for anticipatory bail is rejected.
