JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 16-01-2023 The learned counsel for the petitioner is directed to remove all the defects pointed out by the office within one month. Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in connection with Barari P.S. Case No. 272/2019 registered for offence punishable under sections 302, 120(B), 34 of the Indian Penal Code. As per allegation, co-accused Hariom Sharan Pandit took away the husband of the informant by his motor cycle. Later on, she came to know that her husband, who became injured in an accident, has been admitted in hospital. She has stated further that one month prior to the occurrence, Hariom Sharan Pandit had called her husband from Chennai about a case already filed, which was pending in the court of Sub-Divisional Magistrate, Katihar. She has also stated that Hariom Sharan Pandit and one person of

She has mentioned in the last of her fardbeyan that the petitioner, who is driver, was also involved in the said offence. The learned counsel for the petitioner has submitted that the petitioner is innocent. The main allegation is against Hariom Sharan Pandit. No evidence came against the petitioner during the course of investigation and the investigating authority submitted final form against him.

Considering the above-mentioned facts and circumstances, the petitioner above-named, in the event of his arrest or surrender, within four weeks from today, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar in connection with Barari P.S. Case No. 272/2019, subject to condition as laid down under section 438(2) Cr. P.C.

Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
