The petitioners apprehend their arrest in Guraru P.S. Case No. 107/2015, registered for the offences punishable under Sections 341, 342, 323, 504, 506, 509, 34 of the Indian Penal Code and Section 3 (I)(X)(XI) of the S.C./S.T. (Prevention of Atrocities) Act.
The informant alleged that Pramod Sharma had teased his daughter one month ago and the villagers stopped him to lodge the case and said that they will enquire into the matter, but the accused Pramod Sharma had left the village. On 22.12.2015, the informant saw Pramod Sharma in his village and the informant caught him. It is submitted that no case was earlier filed by the
Patna High Court Cr.Misc. No.16144 of 2016 (2) dt.02-05-2016 2/2 informant. Pramod Sharma filed Guraru P.S. case No. 106/2015 alleging that when he was going to irrigate his field the informant and others assaulted him. There is a case and counter case between the two sides.
Considering the facts aforesaid and the fact that the injuries found on the person of the informant is simple in nature, the above named petitioners, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Special District & Sessions Judge (S.C. and S.T. Act), Gaya in connection with Guraru P.S. Case No. 107/2015, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
