Petitioner, already in custody, seeks bail in connection with Pasraha P.S. Case No.42 of 2018 registered under Section 414 of the Indian Penal Code.

Allegation in brief is that Santosh Kumar and Prashant Kumar were apprehended and on the disclosure of the two apprehended persons one stolen motorcycle was also recovered from possession of the petitioner.

Learned counsel for the petitioner submits that the petitioner had no knowledge how this motorcycle was found at his place and Prashant Kumar and Santosh Kumar have been admitted to bail by this Court as well as by another co-ordinate Bench vide orders dated 17.05.2018 and 31.05.2018 passed in

Patna High Court Cr.Misc. No.34394 of 2018(2) dt.29-06-2018 2/2 Cr. Misc. Nos.30565 of 2018 and 31775 of 2018 respectively, the petitioner is in custody since 06.04.2018 and he has clean antecedent.

Having considered the aforesaid facts and circumstances, the prayer of bail of the petitioner is rejected. However, the petitioner may renew his prayer of bail after framing of charge.
