2. By filing this application, the petitioner has renewed his prayer for regular bail in connection with Nathnagar (Madhusudanpur) P.S. Case No. 94 of 2020 registered for the offences punishable under Sections 341, 307, 34 of the Indian Penal Code and Section 27 of the Arms Act. He has seven criminal antecedents. He is in custody since 14.05.2020.

3. Earlier the prayer for bail of the petitioner was rejected vide order dated 28.07.2021 passed in Cr. Misc. No. 5546 of 2021 for the reasons stated therein which deems his seven criminal antecedents.

4. A report has been received from the learned trial court from which it appears that the prosecution evidence is

Patna High Court CR. MISC. No.50249 of 2022(5) dt.26-07-2023 2/2 going on and at this stage out of five charge-sheet witnesses, two were already examined.

5. Considering the offence alleged and the criminal antecedents of the petitioner, this Court is not inclined to grant privilege of bail to the petitioner at this stage.

6. The learned trial court is directed to expedite the trial and continue with the evidence by keeping the records on day-to-day basis and no unnecessary adjournment shall be granted. All endeavours be made to conclude the trial within a period of four months from the date of receipt/production of a copy of this order.

7. If the trial still remains unconcluded for no reason attributable to the petitioner, it will be open for the petitioner to renew his prayer for bail.

8. Let a copy of this order be forwarded to the Senior Superintendent of Police, Bhagalpur and the Prosecution Officer to ensure presence of the prosecution witnesses on the dates fixed in the matter in the learned court below.
