Having regard to the nature of allegation for offence under Section 302/34 of the Indian Penal Code, though this Court could have granted privilege of anticipatory bail to the petitioner on the ground of omnibus allegation but, then, keeping in view that the petitioner has happily absconded from the year 2002 onwards, he cannot be given such privilege. The prayer of anticipatory bail of the petitioner is accordingly rejected. The petitioner must surrender forthwith before the court below and, thereafter, his prayer for regular bail shall be considered on its own merit without being prejudiced by this order.
