JUSTICE SUDHIR SINGH ORAL ORDER 03-05-2016 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 366A/34 of the Indian Penal Code. Allegation against the petitioner is that he abducted daughter of the informant on his motorcycle.

It is submitted on behalf of the petitioner that he has got no criminal antecedent. Petitioner has falsely been implicated in the present case. The victim girl was recovered and her statement has been recorded under Section 164 of the Code of Criminal Procedure where she has accepted that she had willingly gone with the petitioner. From perusal of Annexure-3 it is evident that petitioner and the said girl (victim) have already got married. On behalf of the State, it is submitted that petitioner is named in the F.I.R. but statement made by the victim under Section 164 of the Code of Criminal Procedure cannot be denied. Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of arrest or surrender in the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two
