The petitioner apprehends his arrest in Falka (Pothia) P.S. Case No.43/2018 registered under Sections 341, 323, 307, 504 and 379/34 of the Indian Penal Code.

The informant alleged that when he went to demand his wages, the petitioner and co-accused Sujeet Kumar Rai caught and assaulted him.

Learned counsel for the petitioner submits that the doctor found injury on the head of the informant. Later on the injury was found to be grievous in nature. It is submitted that the informant in his further statement disclosed that Sujeet Kumar Rai assaulted him with lathi but it appears that the informant made allegation that both Tuntun Rai and Sujeet Kumar Rai assaulted

Patna High Court Cr.Misc. No.34183 of 2018 (3) dt.28-06-2018 2/2 him and he became unconscious but injury on head was opined by the doctor to be grievous in nature.

Considering the aforesaid fact, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected in connection with Falka (Pothia) P.S. Case No.43 of 2018, pending in the court of learned A.C.J.M.-Vth, Katihar. (Prabhat Kumar Jha, J) Amit/- U T
