JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 24-11-2017 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.

This criminal miscellaneous has been filed for quashing the order dated 20.12.2013 passed by learned S.D.J.M., Hajipur at Vaishali, whereby and whereunder the bail bond of the petitioner was cancelled and non-bailable warrant of arrest was issued against the petitioner as the life of the provisional bail granted to the petitioner was expired and for confirming the provisional bail or to extend the time of the provisional bail no application was filed by the petitioner.

The petitioner was granted provisional bail by order dated 14.08.2012 passed in Cr. Misc. No. 27558 of 2012 for one

No.51882 of 2014 (3) dt.24-11-2017 2/2 year and thereafter he surrendered in the court below and he was released on bail in the direction of the Hon'ble Court, but thereafter no petition was filed for confirmation of the provisional bail or for extending the time of provisional bail and then by order dated 20.12.2013 the bail bond of the petitioner was cancelled and non-bailable warrant of arrest was issued. After perusal of the impugned order, it reveals that there is no illegality, incorrectness or impropriety in the said order and the same does not require any interference by this Court.

In the result, finding no merit in this criminal miscellaneous the same stands dismissed.
