JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-11-2019 This is an application for grant of anticipatory bail in connection with Katoriya P. S. Case No. 147 of 2018, disclosing offences under Sections 304B and 120B of IPC. Petitioner happens to be the sister-in-law (Gotini) of the deceased. Case is under Section 304B of IPC. Submission of the learned counsel for the petitioner is that there is no specific allegation either of demand of dowry or of assault against her. The whole family members have been made accused in this case.

Heard learned A.P.P. also, who also could not controvert the fact of no specific allegation has been attributed against the petitioner.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner,

Patna High Court CR. MISC. No.48676 of 2019(3) dt.18-11-2019 2/2 above named, in the event of her arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of Sri Raushan Kumar, learned Judicial Magistrate, 1st Class, Banka, in connection with Katoriya P. S. Case No. 147 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
