JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 21-04-2016 Heard learned Counsel for the petitioners and learned Additional Public Prosecutor for the State. This application, for grant of anticipatory bail, arises out of Khagaria (Mufassil) Police Station Case No. 39 of 2016, disclosing offence under Section 366A/34 of the Indian Penal Code.

As per the First Information Report, one Mritunjay Kumar had kidnapped the daughter of the informant for marriage.

Learned Counsel appearing on behalf of the petitioners has straightaway drawn my attention to the statement of the victim recorded under Section 164 of the Code of Criminal Procedure, wherein she has stated that

Patna High Court Cr.Misc. No.14568 of 2016 (2) dt.21-04-2016 2/2 she and the said Mritunjay Kumar got marriage out of their own volition. She has also stated that there is no role of these petitioners in the alleged occurrence.

Considering the submission, as above, this application is allowed.

Let the petitioners, namely, Puja Kumari and Ravi Kumar, in the event of their arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Khagaria, in connection with Khagaria (Mufassil) Police Station Case No. 39 of 2016, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure. This is subject to the condition that the petitioner shall present themselves before the police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
