The petitioner apprehends his arrest in Aurangabad (Town) P.S. Case No.97/2018, registered under Sections 147, 148, 149, 337, 323, 435, 436, 427, 307, 332, 333, 353, 153(A), 295(A) and 379 of the Indian Penal Code.
Informant Sunil Kumar, Labour Enforcement Officer alleged that on the eve of Ramnavmi Procession, the members of two communities assembled at Khatha-Mitha Restaurant and they indulged in rioting.
Learned counsel for the petitioner submits that Aurangabad (Town) P.S. Case No.95/2018 has been lodged on same and similar allegation. The name of the petitioner has been
Patna High Court Cr.Misc. No.34131 of 2018 (2) dt.28-06-2018 2/2 figured at Sl. No.92 but no specific allegation against the petitioner. Similarly situated other accused persons have already been granted anticipatory bail. Similarly situated co-accused Prabhu Dayal Gupta, Naveen Kumar Sinha and Kavi Kumar have been enlarged on anticipatory bail vide order dated 09.05.2018 passed in Cr. Misc. No.28472 of 2018.
Considering the aforesaid fact, the petitioner above named, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Aurangabad in connection with Aurangabad (Town) P.S. Case No.97/2018, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Jha, J) Amit/- U T
