Heard the learned counsel for the petitioner and learned APP for the State.

The petitioner apprehends his arrest for the offences alleged under Sections 302 and 120(B) of the Indian Penal Code, registered in connection with Shyampur Bhatha P.S.Case No. 124 of 2022.

The learned counsel for the petitioner has submitted that the FIR itself shows that co-accused Nitish Kumar Singh @ Chotu Singh and Amit Kumar Singh opened fire at the person of the deceased and there is no allegation at all on the petitioner to open fire. Only allegation against him is that he, along with co-accused Vinay Kumar Singh @ Binay Singh and Dilip Kunwar @ Dilip Singh, had threatened the deceased prior to the occurrence. He has submitted further that the petitioner has falsely been implicated in this case and coaccused Vinay Kumar Singh @ Binay Singh and Dilip Kunwar @ Dilip Singh have been granted anticipatory bail, vide Cr.

Patna High Court CR. MISC. No.51453 of 2022(2) dt.19-01-2023 2/2 Misc.No. 48169 of 2022 and Cr.Misc. No. 49700 of 2022 respectively.

Considering the above facts and circumstances, let the petitioner above-named, in the event of his arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sheohar in connection with Shyampur Bhatha P.S.Case No. 124 of 2022, subject to the conditions as laid down under Section 438(2) Cr. P.C.

Office shall ensure that all defects are removed by the petitioner within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
