JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 08-01-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Complaint Case No. 3363(C ) of 2013 for the offences punishable under Section 406,420,323 of the Indian Penal Code. The contention of behalf of the petitioner is that no Indra Awas was allotted to the complainant and to fortify the above stated contention, he drew my attention to list of B.P.L series of Indra Awas and at serial no. 55 of the aforesaid list Indra Awas was allotted to one Banita w/o of Mahendra Ram and the father's name of Mahendra Ram has been shown as Yougendra Ram in the aforesaid list and father's name of the present complainant has been shown as Puhum Ram at serial no. 319 of the concerned list.

No.650 of 2015 (2) dt.08-01-2015 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of his arrest/surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of the Sri A..K. Dixit Judicial Magistrate 1st class, Araria in Complaint Case No. 3363(C ) of 2013, subject to condition as laid down under Section 438(2) of the Cr.P.C.
