JUSTICE DINESH KUMAR SINGH ORAL ORDER 06-01-2015 Heard learned counsels for the petitioner and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 364, 354A, 379, 504 and 506/34 of the Indian Penal Code. The prosecution case is that the accused persons including the petitioners assaulted and confined the husband of the informant and when the informant went to rescue, she was also being assaulted and threatened that unless the husband of the informant executes the sale deed of adjacent land, he will not be released.

It is submitted by learned counsel for the petitioners that the mother of the husband of the informant lodged Saur Bazar P.S. Case No. 360 of 2014 against the informant and her husband for

Patna High Court Cr.Misc. No.52095 of 2014 (2) dt.06-01-2015 2/2 kidnapping of her other son. The petitioners being the Panchayat Representatives were punches in the fight between the two brothers of the husband of the informant as a result of which they have been roped in the present case. At present the husband of the informant is in custody in the case lodged by his mother. A statement has been made in para 3 of the petition that the petitioners have no criminal antecedent.

Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Saharsa in connection with Saur Bazar P.S. Case No. 352 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
