The petitioner apprehends arrest in Arrah Muffasil P.S. Case No. 198 of 2014 dated 19.09.2014 instituted under Sections 363/364A of the Indian Penal Code. The allegation against the petitioner is that he had called and taken the informant to the bus stand and handed him over to co-accused Md. Jakir Ansari. Learned counsel for the petitioner submits that he has been falsely implicated for the reason that he is friend of co-accused Md. Jakir Ansari. Learned counsel draws the attention of the Court to Annexure-2, which is a copy of the statement of the victim boy before the Court under Section 164 of the Code of Criminal Procedure, 1973 in which he has stated that the petitioner had called him and taken him to Md. Jakir Ansari who in-turn brought him to Ara and then took
Patna High Court Cr.Misc. No.51230 of 2014 (2) dt.21-05-2015 2/2 him to Delhi where he resided along with Md. Jakir Ansari and his brother peacefully. It is further submitted that the petitioner has clean antecedent.
Learned A.P.P. is not in a position to dispute the statement of the victim recorded by the Court. Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhojpur at Arrah in Arrah Muffasil P.S. Case No.198 of 2014, subject to the conditions laid down in Section 438 (2) of the Code of Criminal Procedure, 1973.
