The petitioners apprehend their arrest in Lakhaura Mufassil P.S. Case No. 13 of 2015, registered for the offences punishable under Sections 304(B), 201 and 34 of the Indian Penal Code and under Sections 3 and 4 of the Dowry Prohibition Act. The informant father of the deceased alleged that his daughter Rinku Devi married to Amod Kumar in the year 2008, but her husband and other in-laws were demanding additional dowry and killed his daughter.
It is submitted that the petitioners are mother-in-law and sister-in-law of the deceased. No specific allegation is made against the petitioners. During lifetime of the deceased no
Patna High Court Cr.Misc. No.16465 of 2016 (2) dt.12-05-2016 2/2 complain was ever made for demand of dowry against any in-laws of the deceased. The brother-in-law of the deceased has already been enlarged on anticipatory bail.
Considering the facts aforesaid and the fact that the petitioners are mother-in-law and sister-in-law of the deceased and no specific allegation has been made against them, the petitioners above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran at Motihari in Lakhaura Mufassil P.S. Case No. 13 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
