ANJANA MISHRA ORAL ORDER 17-07-2018 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 14.05.2018 in connection with Kazimohammadpur P.S. Case No.227 of 2018 registered for the offence under Sections 354(A)(I)(i)(iii), 354(D), 506 I.P.C. and Section 8 of the POCSO Act. Learned counsel for the petitioner submits that only because there is dispute with regard to the payment of tuition fee and because the petitioner is poor and had been demanding his tuition fee, that the present case has been instituted against him with false and malicious allegation. The petitioner has been in custody for over two months and has got no criminal antecedents.

No.36930 of 2018 (2) dt.17-07-2018 2/2 Considering the aforementioned facts and circumstances of the case, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, POCSO Act, Muzaffarpur, in connection with Kazimohammadpur P.S. Case No.227 of 2018.
