The petitioner has filed the instant application for grant of regular bail in connection with Nasriganj P.S. Case No. 33 of 2022 registered under sections 307, 34 of the Indian Penal Code and Section 27 of the Arms Act.

Allegation against the petitioner and other co-accused persons is that they started abusing and assaulting to the informant's son with pistol, due to which he sustained fire arm injury on his forearm.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this present case merely on suspicion. It is further submitted that there is no repetition of shot fire and

Patna High Court CR. MISC. No.51365 of 2022(4) dt.07-02-2023 2/2 no intention to kill the informant's son by the petitioner. Only one fire arm injury sustained on the forearm of the injured as per medical report. The petitioner is languishing in judicial custody since 06.05.2022.

The application for bail is vehemently opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, the Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Nasirganj P.S. Case No. 33 of 2022 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. 1st Class, Bikramganj, Rohtas.
