Case No. 146 of 2014 registered under sections 341, 323, 506, 504/34 of the Indian Penal Code and section 3(1)(X)(xI) of SC/ST Act.
Learned counsel for the petitioner draws attention of this court and states that in fact the actual fight is between wife of the petitioner and the wife of the informant because they were candidates of Asha workder. The petitioner was not selected whereas the wife of the informant was selected on the basis of forged papers and the petitioner has filed complaint on the basis of which the wife of the informant was removed. Thereafter petitioner's wife was selected. It is in retaliation of this false case has been lodged. So far SC/ST Act is concerned,
Patna High Court Cr.Misc. No.50712 of 2014 (2) dt.26-05-2015 2/2 learned counsel submits that as per the allegation in the first information report itself calling by caste name in the Murdghatti (cremation ground) which is not a public place. Considering the aforesaid facts, the above named petitioner in the event of arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of S.D.J.M, Rosera, in Singhia P.S. Case No. 146 of 2014, subject to the conditions as laid down under section 438(2) Cr.P.C. (Navaniti Prasad Singh, J) M.Rahman/- U T
