2. The instant application for anticipatory bail has been filed by the petitioners apprehending their arrest in connection with Tarari P.S. Case No. 56 of 2025 instituted for the offence under Sections 126(2), 115(2), 109, 303(2), 351 and 352 of the B.N.S.
3. The case of the prosecution is that the petitioners along with others have assaulted the son of the informant. There is specific allegation against one Raja Paswan that he has assaulted near ear of the informant's son.
4. Learned counsel for the petitioners has submitted that from perusal of the FIR itself it is clear that police was informed on 112 and police has reached the place of occurrence. It has also been submitted that the informant is not the eye-
Patna High Court CR. MISC. No.48676 of 2025(2) dt.05-08-2025 2/2 witness. The nature of allegation is general and omnibus and the injury which has been suffered by the son of the informant is simple in nature. The petitioners are having no criminal antecedent.
5. Learned APP for the State has vehemently opposed the bail of the petitioners.
6. Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioners on bail. The petitioners are directed to surrender in the Court below within a period of four weeks from today and in the event of their arrest or surrender in connection with Tarari P.S. Case No. 56 of 2025, they will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) each of them with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate- 1st Class, Bhojpur at Ara, subject to the conditions as laid down under Section 482(2) of the BNSS.
7. Accordingly, the present bail application stand allowed.
