Heard the learned counsel for the petitioner and learned APP for the State.

The petitioner apprehends his arrest for the offences alleged under Sections 147, 148, 149, 341, 323, 353, 224, 225, 188, 269, 270, 332, 333 and 504 of the Indian Penal Code, registered in connection with Abadpur P.S.Case No. 86 of 2020.

The petitioner is also an accused in Abadpur P.S. Case No.35 of 2020. The informant on confidential information that the petitioner was present at the shop of one Islam, went

Patna High Court CR. MISC. No.11567 of 2021(2) dt.23-12-2021 2/3 there and apprehended the petitioner in presence of two independent witnesses. Thereafter 10-12 persons of the locality assembled there and they forcibly rescued the petitioner from the hands of the police.

The learned counsel for the petitioner has submitted that the learned Sessions Judge has granted anticipatory bail to the co-accused persons against whom there was allegation of rescuing the petitioner. So far as Abadpur P.S.Case No. 35 of 2020 is concerned, it has been mentioned in paragraph 9 of the bail petition that the present petitioner was granted anticipatory bail by the learned Sessions Judge vide order dated 16.09.2020. Considering the above facts and circumstances, let the petitioner above-named, in the event of his arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Smt. Jai Shri Kumari, learned Judicial Magistrate, 1st Class, Katihar in connection with Abadpur P.S.Case No.86 of 2020, subject to the conditions as laid down under Section 438(2) Cr. P.C.

Office shall ensure that all defects are removed by the petitioner within the stipulated time as provided
