JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 04-05-2016 Heard the counsel for the petitioner and the State. At least on two occasions, the petitioner did not appear on call, and that is the reason for dismissal of anticipatory bail application for non prosecution vide order dated 01.03.2016. The anticipatory bail application was filed in November and was dismissed for non prosecution in March 2016. The petitioner will also have to state as to whether the same has become infructuous or not by passage of time.
On going through the pleadings and after hearing the parties, I am not satisfied that a case for restoration is made out. The application is dismissed.
Dismissal of this application shall, however, not preclude the petitioner from filing appropriate applications afresh, if the cost survives.
