Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 363, 366A, 504, 506/34 of the Indian Penal Code.

The basic accusation is of abducting the minor daughter of the informant by the petitioner and his brother. It is submitted by the learned counsel for the petitioner that in 164 Cr.P.C. statement the victim has specifically stated that Guddu Kumar ravished her. The petitioner has roped in the present case since he is brother of Guddu Kumar.

Considering the fact that in 164 Cr.P.C. statement the victim got her age recorded 14 years, the Court assessed her aged 10 years and the accusation of abduction has been levelled by the victim against the petitioner also. Though the

Patna High Court Cr.Misc. No.15001 of 2016 (2) dt.11-04-2016 thrust of accusation for ravishing the victim is against Guddu Kumar, let the learned court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Kankarbagh P.S. Case No. 662 of 2014, pending in the court of learned Smt. Sunita Raj, J.M., Ist Class, Patna.

With the above observation this application is disposed of.
