Learned counsel for the petitioners is permitted to remove defect(s), as pointed out by the office, if any, within a period of four weeks from today.

The petitioners seek anticipatory bail in connection with Garkha P.S. Case No. 542 of 2021, registered for the offences under Sections 341, 323, 354(B), 379, 506, 504/34 of the Indian Penal Code.

Learned counsel for the petitioners submits that against petitioner no. 2 Prabhunath Ray @ Bhola Ray there is no serious allegation, only one injury has been found at the person of the informant and both the parties are co-villagers in between them there

Patna High Court CR. MISC. No.60961 of 2021(2) dt.07-06-2022 2/2 is dispute over a water-through (Nala).

Learned APP has vehemently opposed the prayer for anticipatory bail of the petitioners.

Heard both the sides and perused the FIR and the annexure-2 concerned to the injury report of the informant Savita Devi. As per injury report the said injured sustained sharp cut injury on her vital part. There is specific allegation against the petitioner no. 1 and the petitioner no. 2 also actively participanted in the occurrence. The nature of allegation appearing from the FIR is serious and the case is under investigation.

Considering the above facts, this application for anticipatory bail is dismissed.
