JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 28-06-2018 Heard learned counsel for the petitioners and State. The petitioners are in custody in connection with Ghorasahan P.S. Case No. 45 of 2017 for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioners submits that the liquor in question was recovered near the house of Kishore Paswan, who has already been granted bail vide order dated 07.06.2017 in Cr. Misc. No. 26381 of 2017. Learned counsel further submits that petitioner no.1 was, in fact, granted anticipatory bail by a co-ordinate Bench of this Court vide order dated 11.07.2017 in Cr. Misc. No. 24674 of 2017, but he could not

Patna High Court Cr.Misc. No.37213 of 2018 (2) dt.28-06-2018 2/2 surrender within time granted by the Court. The petitioners are in custody since 26.05.2018.

Considering the fact that at one point of time, the petitioner no.1 was granted anticipatory bail by a co-ordinate Bench of this Court, the petitioners, named above, are directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned 7th Additional Sessions Judgecum-Special Judge, Excise, East Champaran, Motihari in connection with Ghorasahan P.S.
