The petitioner, in the present case, is seeking regular bail in connection with Chautham P.S. Case No.139 of 2014, registered for offences alleged under Sections 457 and 380/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is not named in the FIR. Nothing incriminating has been recovered from his possession and save and except his confessional statement no evidence has been collected by police against him. It is further submitted that one of the co-accused from whose possession one Payal and Bichiya was recovered has been granted bail.

Patna High Court Cr.Misc. No.37314 of 2018 (2) dt.29-06-2018 Learned APP for the State is present.

Considering the facts and circumstances whereunder nothing incriminating has been recovered from the possession of the petitioner and prior to the present case he has no criminal antecedent, let the petitioner, above named, be enlarged on bail on his furnishing bail bond of Rs.15,000/- (fifteen thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-1st Class, Khagaria in connection with Chautham P.S. Case No. 139 of 2014, subject to the conditions U/S 437(3) Cr.P.C.
