JUSTICE ASHUTOSH KUMAR ORAL ORDER 19-07-2018 The petitioner seeks bail in anticipation of his arrest in connection with Delha P.S. Case No. 95 of 2018 dated 13.04.2018 instituted for the offences under Sections 406, 420, 34 of the Indian Penal Code.
The informant and about four others had purchased a plot of land from three persons including the petitioner for a total consideration amount of rupees ten lakhs and odd. Later, the informant and others (vendees) realized that the land does not have any ingress and egress and there is some dispute pending over the land also and refused to purchase the land and hence demanded their money back. When the money was not been given to the informant and other investors, the subject F.I.R was lodged.
The learned counsel for the petitioner has submitted
Patna High Court Cr.Misc. No.37083 of 2018 (2) dt.19-07-2018 2/2 that one of the land holders viz. Pramod Kumar has paid rupees four lakhs to the informant.
The aforesaid statement of the counsel for the petitioner has not been disputed by the learned counsel appearing for the informant.
The petitioner has also paid rupees one lakh and sixty thousands and has entered into an agreement with the informant that the balance amount of rupees four lakhs and ninety thousands shall be paid by the third land holder viz. Md. Nasim and the petitioner shall make efforts to have the balance money paid to the informant.
Considering the aforesaid development in the case, the petitioner above named, in the event of his arrest or surrender before learned Court below within a period of four weeks from today, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, VII, Gaya in connection with Delha P.S. Case No. 95 of 2018, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
