Heard learned counsel for the petitioner and the State. The petitioner seeks regular bail in Bhaptiyahi Police Station Case No. 32 of 2019 registered for the offences punishable under section 392 of the Indian Penal Code. As per the prosecution case, at night when the informant was returning to his house on motorcycle, suddenly four motorcycle borne unknown miscreants overpowered him and on the point of pistol snatched his motorcycle, mobile phone, golden chain, cash Rs.20,000/-, office Tab, driving licence etc.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. No incriminating material has been recovered from the conscious possession of the petitioner. Petitioner is in custody since 10.1.2020.

Learned counsel for the State opposes the prayer for bail and submits that the looted motorcycle has been recovered from the house of the petitioner. More so, he is accused in four other criminal cases as per his averment made in paragraph 3 of the bail petition.
