JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02/ 26.02.2015 Heard learned counsel for the petitioners as well as learned Addl. Public Prosecutor for the State.

Petitioners apprehend their arrest in connection with Baniapur P. S. case no. 219/2013 registered under sections 147, 148,149, 380, 504 of the IPC and section 3 (I) (X) (XV) of the SC/ST (Prevention of Atrocities ) Act, 1989.

It appears that having got information of a murder, police party went to the place of occurrence and petitioners and several other villagers are said to have attacked on the police party as well as house of the accused of the aforesaid murder. It further appears that apart from present case Baniapur P. S. case no. 220/2013 was lodged against the petitioners and others for similar occurrence and in the aforesaid case, petitioners have already been granted privilege of

Patna High Court Cr.Misc. No.7366 of 2015 (2) dt.26-02-2015 anticipatory bail by a bench of this court vide order dated 20.2.2015 passed in Cr. Misc. no. 7066/2015.

Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that in the event of arrest/ surrender within four weeks from the date of receipt of this order to the concerned court, let the above named petitioners be released on bail on furnishing bail bonds of Rs 10,000/- each with two sureties of the like amount each to the satisfaction of Sri Brijesh Kumar, Judicial Magistrate, Ist Class, Saran at Chapra/concerned court in Baniapur P.
