JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-03-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Shahpur P.S. Case No. 21 of 2015 registered for the offences punishable under Sections 147, 448, 323, 307, 427, 506 of the Indian Penal Code and 27 of the Arms Act.
There is case and counter case between the parties and according to prosecution case itself, the alleged occurrence took place on account of land dispute. Annexure-3 to this petition shows that the informant of the present case sustained two injuries. One injury was found below right eye whereas one abrasion was found on index finger.
Although, the opinion regarding the aforesaid two injuries was kept reserved but considering the facts and

No.10818 of 2015 (2) dt.20-03-2015 circumstances of the case as well as nature of injury sustained by the informant, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of his arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhojpur at Ara in Shahpur P.S. Case No. 21 of 2015 subject to condition as laid down under Section 438(2) of the Cr.P.C.
