The petitioner apprehends his arrest in a case under Sections 385, 387, 307, 34 of the Indian Penal Code and Section 27 of the Arms Act.
The informant named the petitioner along with two others and alleged that they came to his house and made indiscriminate firing. It is submitted that the petitioner has been falsely implicated in the case due to previous enmity. The informant did not sustain any injury. Co-accused Ranjeet Choudhary has already been granted anticipatory bail by a coordinate bench of this Court vide order dated 09.11.2015 passed in Cr. Misc. No. 52307/2015. Learned A.P.P. did not dispute this fact.
Considering the fact that the case of the petitioner
Patna High Court Cr.Misc. No.16421 of 2016 (2) dt.10-05-2016 2/2 stands on the same footing as that of Ranjeet Choudhary, who has already been enlarged on anticipatory bail, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Santosh Kumar, J.M. 1st Class, Begusarai in Bhagwanpur P.S. Case No. 181/2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Jha, J) Dilip/- U T
