1. Heard the parties.

2. The petitioner has filed the present writ application for setting aside the order dated 01.02.2024 passed by the Chief General Manager, Bihar State Building Construction Corporation Limited, Patna whereby and whereunder the security money of Rs. 16,50,000/- deposited as earnest money in terms of the E-tender clause 17 dated 22nd October, 2018 has been forfeited.

At this stage, learned counsel for the respondents pointed out notification / order dated 07.05.2007 under which petitioner has remedy of appeal before the Appellate Authority under Para 11 ( ?k ). Therefore, the petitioner is at liberty to invoke such remedy before the concerned authority. If necessary, he is permitted to file interlocutory application before the Appellate Authority seeking for condonation of delay.

4. The Appellate Authority is hereby directed to take note of delay issue and proceed to pass order within a period of three months from the date of receipt of such appeal to be filed on behalf of petitioner. The writ petition is accordingly disposed with the aforesaid liberty granted.
