The petitioner apprehends his arrest in Wazirganj P.S. Case No. 302/2014, registered for the offences punishable under Sections 147, 148, 149, 452, 341, 323, 324, 307, 504 of the Indian Penal Code and Section 27 of the Arms Act.
The informant alleged that at 11.00 a.m. some people of Dakhin Gaon came and assaulted the customer. The informant intervened, but the accused persons fled away. There were the informant and others. It is alleged that after sometime Rakesh Kumar and others having armed with different weapons came to his shop and Rakesh Kumar fired causing injuries at the chest of the informant. The informant caught Rakesh Kumar and the accused persons dragged the informant, but in the meantime police
Patna High Court Cr.Misc. No.16966 of 2016 (2) dt.16-05-2016 2/2 also came there and caught Rakesh Kumar.
It is submitted that petitioner is brother of Rakesh Kumar. There is no allegation against him. He is working in Marine Company, but it appears that the informant has made very specific allegation that the petitioner was also accompanying his brother Rakesh Kumar who fired causing injury on the chest of the informant and thereafter all the accused persons dragged the informant.
Considering the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail in Wazirganj P.S. Case No. 302/2014, pending in the court of learned Chief Judicial Magistrate, Gaya. Accordingly, the same is rejected. (Prabhat Kumar Jha, J.) Vinita/- U T
