JUSTICE ARUN KUMAR ORAL ORDER 05-07-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 14.3.2018, seeks bail in Manjhi PS Case No. 56 of 2018 registered under Sections 399, 402 of the IPC and Sections 25(1-b)a, 26 and 35 of the Arms Act. The allegation in brief is that the police on receiving information raided the poultry farm of the petitioner however all miscreants escaped away but the petitioner was apprehended and one country made pistol and three live cartridges were recovered from his possession.
Learned Counsel for the petitioner submits that the petitioner is a businessman, runs a poultry farm and has no criminal antecedent, implication is false regarding recovery of fire arm and has been in custody since 14.3.2018.
Having considered the said facts and circumstances, the petitioner, namely, Sonu Kumar Singh @ Sonu Singh is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM Vth, Saran at Chapra in connection with Manjhi PS Case No. 56 of 2018.
