JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-11-2019 This application, for grant of anticipatory bail, arises out of Industrial Area P.S. Case No. 208 of 2018, disclosing offences under Sections 406, 420, 323, 504 and 120(B) of the Indian Penal Code.

Allegation against the petitioner and other accused person is of taking Rs. 1.50 Lakh from the informant for providing employment but he neither provided employment nor returned the money.

Submission of learned counsel for the petitioner is that now parties have settled the dispute and a compromise petition has also been filed before the Court below. Learned counsel for the Sate opposed the prayer for anticipatory bail on the ground that the witnesses have

Having heard both sides, considering the facts and circumstances of this case, this application is disposed of with direction to the petitioner to surrender in the court below on 28.11.2019 and the learned court below shall verify the above submission of the petitioner with respect to compromise between the parties and if it is found that the parties have compromised the dispute, the court below shall release the petitioner on bail to his own satisfaction, otherwise, petitioner has to surrender and pray for regular bail.
