====================================================== CORAM: HONOURABLE MR. JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 16-12-2021 Learned counsel for the petitioner is directed to remove all the defects pointed out by the Stamp Reporter within one month.

Heard the learned counsel for the petitioner and learned APP for the State.

The petitioner apprehends his arrest for the offences alleged under Sections 341, 323, 324, 307, 380 and 504/34 of the Indian Penal Code, registered in connection with Kuchaikote P.S.Case No. 322 of 2020.

As per the FIR, the informant was asking his father for partition amongst his three brothers. Then the accused persons named in the FIR came and badly assaulted the informant and his family members.

Learned counsel for the petitioner has submitted that the allegation against the present petitioner is that he inflicted sword blow on the head of the informant, but the injury report

Patna High Court CR. MISC. No.7219 of 2021(2) dt.16-12-2021 2/2 annexed as Annexure-3 shows that the injury sustained by the informant is simple in nature and caused by hard and blunt substance.

Considering the above-mentioned facts and circumstances as well as the nature of the allegation and the injury sustained by the informant, let the petitioner abovenamed, in the event of his arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VIIth, Gopalganj, in connection with Kuchaikote P.S.Case No.322 of 2020, subject to the conditions as laid down under Section 438(2) Cr. P.C. Office shall ensure that all defects are removed by the petitioner within the stipulated time provided in para 1 hereinabove, failing which the matter shall be brought to the notice of this Court.
