2. The petitioner is apprehending arrest in connection with Parbatta P.S. Case No. 394 of 2025 for the offence under Sections 126(2), 115(2), 352, 351(2), 109(1), 3(5) of the Bhartiya Nyaya Sanhita.

3. As per prosecution case, in short, is that on 19.10.2025, while the informant was returning from the shop of his village, the petitioner and other accused persons blocked his path and started abusing when the informant objected such abuse, they started assaulting him. It is further alleged that the petitioner put the towel around the informant's neck and pull the same while others were beating him. On the intervention of the

Patna High Court CR. MISC. No.49571 of 2026(2) dt.22-07-2026 2/3 villagers and family members of the informant, the petitioner fled but the petitioner and other accused persons continue to follow the informant till the hospital.

4. Learned counsel for the petitioner has submitted that petitioner is innocent and has falsely been implicated in this case. It has been further submitted that the petitioner and the informant are co-villager and there is case and counter case between the parties. Petitioner has no criminal antecedent and the allegations made against the petitioner is false, baseless and malicious.

5. Learned APP for the State vehemently opposed the prayer of anticipatory bail of the petitioner.

6. Keeping in view the fact, that the allegation in respect to the petitioner of using a towel resulted in a simple injury to the informant, I am inclined to grant the petitioner benefit of anticipatory bail. Let the petitioner above named, in the event of arrest/surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court is connection with Parbatta P.S. Case No. 394 of 2025, subject to the conditions as laid down under Section 482(2) of the Bhartiya
