JUSTICE DINESH KUMAR SINGH ORAL ORDER 05-01-2015 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 409/34 of the Indian Penal Code.
It is alleged that the petitioner no.1 being the Sewika of Anganbadi Centre in the district of Arwal and the petitioner no.2 being the Chairman of Purchase Committee withdrew a sum of Rs. 90,000/-. It is submitted by the learned counsel for the petitioners that vide letter 126, dated 11.04.2014, the Child Development Project Officer directed the petitioners to get the money deposited otherwise FIR will be lodged but on the same day the FIR was instituted though the money was deposited on 29.08.2014.
Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or
Patna High Court Cr.Misc. No.51803 of 2014 (2) dt.05-01-2015 2/2 surrender before the learned court below within a period of 12 (twelve) weeks from today, on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Jehanabad in Arwal P.S.cse No. 87/2014, subject to the conditions as laid down u/s 438(2) Cr.P.C. The bail bonds of the petitioners shall be provisionally accepted till the verification to the effect that the amount has already been deposited. (Dinesh Kumar Singh, J) singh/- U T
