In this case, the petitioner is apprehending his arrest in connection with Complaint Case No. 911 of 2011 (Tr. No. 2491 of 2017) registered for offences under sections 417/405 of the Indian Penal Code.

As per complaint petition, the petitioner had given an impression for arranging a job in foreign service, Ajad Ali was introduced, the Complainant gave altogether Rs. 1,00,000/- to Azad Ali along with passport to the petitioner which was handed over to Azad Ali which is absolutely clear from the statement made in the complaint petition but, neither the money has been returned nor the job was given to the son of the

Patna High Court Cr.Misc. No.37146 of 2018(2) dt.03-07-2018 2/2 Complainant Learned counsel for the petitioner submits that so far Azad Ali is concerned, he has been granted bail by this Court vide order dated 7.5.2014 passed in Cr. Misc. No. 12311 of 2014.

Looking to the entire facts and circumstances of the case, let the petitioner, namely, Bishram Pandit, in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Gopalganj in connection with Complaint Case No. 911 of 2011 (Tr. No. 2491 of 2017) , subject to the conditions as laid down under Section 438(2) of the Cr.P.C. as also subject to condition that whenever the police will call the petitioner for investigation/interrogation, he will remain present and if he would not present himself, the privilege of grant of anticipatory bail shall be deemed to have been canceled.
